April 7, 2015 Varick ZBA Meeting Location and Time

Please note that the April 7, 2015 Varick Zoning Board of Appeals meeting will be held at the Varick Fire House on 96A at 7PM and not at the Town Hall. 

The door will be open at 6:30PM.

This will be the second hearing regarding Steven and Mellissa Zeitler, 5326 East Lake Road, Romulus, NY, requesting a side setback variance to allow construction of a structure with less than the minimum 10 ft. setback from the south side property line.  The original proposal would require a variance to place the proposed structure 3ft from the property line.  This matter was adjourned from March 10, 2015 by the ZBA with a request for additional information from the applicants.

LEGAL NOTICE OF PUBLIC HEARING

A public hearing before the Town of Varick Zoning Board of Appeals will be held on
Tuesday, March 10, 2015 at 7 PM in the Town Office Building on Rt. 96 for two applications
pertaining to area variances. A public hearing for an area variance is requested under Section
703.2 of the Varick Zoning Code. The Zoning Board will consider the following appeals for area
variances resulting from permits denied due to minimum setback requirements as stated in Town
of Varick Zoning Code 309.1: 

(1) Steven and Mellissa Zeitler, 5326 East Lake Road, Romulus, NY, requesting a side setback
variance of 7 ft. as opposed to the minimum 10 ft. setback; and

(2) Gene and Katharine Tolomeo, 5626 East Lake Road, Romulus, NY, requesting a center of road
setback variance of 27 feet as opposed to the minimum 50 ft. setback; and a side setback variance
of 6 feet as opposed to the minimum of 10 ft .

Said applications are on file and open for inspection at the Town Office Zoning Board of Appeals
located at the Town Barn on Route 96. Persons wishing to appear at the Hearing may do so in
person, by an attorney or by other representative. Communications in writing thereto may be
filed with the Board at the Town Building or at the Hearing.

January 13 Meeting Canceled

The ZBA has had no hearing requests or requests for interpretation submitted prior to our scheduled Jan 13, 2015 meeting.  Absent an emergency requiring more urgent attention, our next meeting will be the second Tuesday in March, March 10th.

Requests for variances, interpretations, or appeals from code enforcement decisions can be filed prior to that meeting to be heard on March 10, 2015.  We ask that you file such requests and appeals at least 3 weeks prior to the meeting (Feb 17, 2015) so that we can issue the appropriate public notices.

The Varick ZBA meets on odd months, on the second Tuesday.  The next meeting is scheduled for November 11, 2014.

ZBA Hearing - Request for Area Variance

On 9/9/2014 the ZBA heard a request for area variance. The Zoning Compliance Permit Application and Application for a Variance submitted by S. Mayer of 5475 East Lake Road were reviewed. The property is located in the Lake Shore Residential area. Applicant requested 1.7 feet variance to comply with the code of 10 feet from the side property setback.

LEGAL NOTICE

On Monday, August 26, 2013,  at 7 PM the Varick Zoning Board of Appeals will hear an application for a Use Variance to permit the property at 4524 State Route 96A to be used for vehicle sales, a use prohibited by the Varick Zoning Code in the ARR zone.
