PUBLIC HEARING Varick Zoning Board of Appeals will be held on July 25, 2017 in the Town Office Building at 4782 Route 96 for an Application for an Area Variance filed by Dwight Lindler . A public hearing for an area variance is requested under Section 306.3 of the Varick Zoning Code for property located at 5519 Route 89, in the Town of Varick, Lot 513 Section 219, Block 2.17.94. The Zoning Board of Appeals will hear and consider the appeal for an area variance which seeks relief from minimum side setbacks for boat hoists. Said application is on file with the Zoning Board of Appeals and the Town Clerk and is open for inspection.

A PUBLIC HEARING before the Town of Varick Zoning Board of Appeals will be held on July 25, 2017 at 7:00 PM in the Town Office Building at 4782 Route 96 for an Application for an Area Variance filed by Enos Hertzler . A public hearing for an area variance is requested under Section 311.7 of the Varick Zoning Code for property located at 2473 Ogden Road, Seneca Falls, parcel 4-1-47.2, in the Town of Varick. The Zoning Board of Appeals will hear and consider the appeal for an area variance which seeks relief from the 100' minimum setback for a commercial retail building from a side property line. Said application is on file with the Zoning Board of Appeals and the Town Clerk and is open for inspection.

The Varick ZBA held a public meeting at the Varick Town Hall on April 25, 2017 at 7pm.
Present: Jeff Hogue-Chair, Annie Bachman, John Keel, Fred Beary, Andrew Herkovic
Meeting was called to order at 7:04 pm.

Notice of Action sent to property owner Jesse McNulty and the clerk.
Motion to approve March minutes with the correction of the proper newspaper notice.
Motion Approved.
New Business:
A workshop comparing dock and waterfront rules from other towns started at 7:15pm.
1. The Army Corps of Engineers. A. Bachman e-mailed document to all board members. Request was for an application, received a permit. No application found. Determined the process is to submit a request and the general permit is granted as long as the dimensional requirements are met. Pre-construction notification is needed if you vary from the dimensional restrictions. Variances can be obtained when special conditions are presented (i.e. - physical obstructions, etc.). Deck vs. Dock definition varies somewhat from Varick Zoning Codes. They permit for a very large boat/jet ski hoist size. Mooring buoys & swim platforms are to have identification tags. VZC are stricter and variance decisions should always include the instruction to comply with the Army Corps of Engineers requirements (which include instructions to contact/comply with State and Federal regulations including the Coast Guard).
2. Town of Auburn. Document brought by J. Hogue. No dock regulations found. Permit requirement is one large document. A complicated but thorough document. Examples are included for most all items including diagrams. What items you can do yourself or have to have a contractor.
3. Owasco, Scipio???? Document brought by J. Hogue. Shoreline construction is highly regulated as to size, proximity, and construction method. Size limits are for much smaller dock structures due to small body of water. No structures can be built on the dock with the exception of seating.
Related Notes/ Questions: Different dock building companies are on Seneca and Cayuga Lakes (too difficult to move equipment from one lake to the other). Do dock builders have to be registered? Are there any NY State law requirements for dock (size)? The terms 'Pier' and 'Dock' are used interchangeably referring to the same structure. Docks were originally 'access to the water/ boat’, now have become activity locations. Suggestions for rules to be considered for change/ clarification and what are the procedures to have them considered/ implemented by the Town (i.e. maximum sq. ft. limits)? Should the rules be defined for Seneca Lake vs. Cayuga Lake considering the very different densities they have?
Special Note: Both Lakes are currently at or close to the mean high water mark.

The Varick ZBA held a public meeting at the Varick Town Hall on May 23, 2017 at 7pm.

Meeting was called to order at 7:07 pm.

Motion to approve April minutes, with a change in phrasing for clarity of the request from the Army Corps of Engineers for an application from them for a variance.
Motion Approved.
New Business:
Property owner Linda Mastellar in attendance.
Notices for a Public Hearing for an Area Variance on Permit No. 17-1716 mailed to property owner, Linda Mastellar, and neighbors, but the newspaper notice did not get published. L. Mastellar believes the property was subdivided sometime in the 1970's, maybe earlier. They purchased the land in approx. 2008, with right of way access prior to the purchase. The size of the lot seems to pre-date the current subdivision code. The temporary dock that they have been maintaining pre-dates their ownership.
All further discussion tabled until the June 27, 2017 meeting.
Note: Letters from neighbors unable to attend the meeting expressing their comments/ concerns and whether they are for or against the area variance application are acceptable.
While continuing to explore other town zoning rules, A. Bachman e-mailed members with a link to the Romulus and Fayette zoning codes, that have a 100' lake front minimum and 15' on either side of the dock.
